  1. Adoption and Children (Scotland) act 2007

    The revised Guidance on the 2007 Act and the Looked After Children (Scotland) Regulations 2009 was published, electronically only, on the Scottish Government website ( under Publications, 10 March 2011

    On 16 March 2011, the Scottish Government issued a consultation about fee charging for processing intercountry adoptions. The document is available on the website at Consultations and responses are sought by 30 May. The fee proposed is 1,775 [pounds sterling], subject to means testing, to come into effect from 1 August 2011.

    Since the previous notes, two further orders have been made relating to the 2007 Act (see

    (a) Adoptions with a Foreign Element (Scotland) Amendment Regulations 2011, SSI 2011/159. These contain further amendments to the Adoptions with a Foreign Element (Scotland) Regulations 2009, SSI 2009/182, which have already been amended by the Adoptions with a Foreign Element (Scotland) Amendment Regulations 2010, SSI 2010/173.

    (b) Act of Sederunt (Jurisdiction in Respect of Parental Responsibility and Measures for the Protection of Children Rules) 2011, SSI 2011/192. These amend sheriff court rules to take account of the Parental Responsibility and Measures for the Protection of Children (International Obligations) (Scotland) Regulations 2010, SSI 2010/213.

    The main amending Order under section 104 of the Scotland Act 1998 is still awaited.

  2. Children's Hearings (Scotland) Act 2011.

    The 2011 Act received Royal Assent on 6 January 2011, after being passed by the Scottish Parliament on 25 November 2010. Information about the Bill is available on under Previous Bills, and the Act itself is available on The Act provides for a new body, Children's Hearings Scotland, to manage the hearing system and panel members (excluding SCRA) and Bernadette Monaghan was appointed as the first National Convener in February 2011.

    The 2011 Act will also replace the provisions in the 1995 Act covering the hearing system, Child Protection Orders, child assessment orders and emergency protection measures, with implementation currently anticipated by the summer of 2012.

  3. Child protection.
